VAR Value Added Reseller Agreement (VAR)
A VAR is licensed to enhance, combine and resell the data including Vicmap products.
The VAR agreement between the Department of Sustainability and Environment and a Value Added Reseller (usually a private sector company) covers sub-licensing, liability, intellectual property and disclaimers. The usual term is two years. Schedules cover datasets, purpose, updates, licence fees and performance criteria.
The end user (ie. the customer of the VAR) will sign an EULA End User Agreement with the VAR or accept the terms and conditions by opening a shrink wrapped package or clicking a button online.
.
Data Service Provider Agreement (DSP)
A DSP does not use, enhance or modify the dataset in any way. They are simply a distribution channel. The DSP agreement between the Department of Sustainability and Environment and a Data Service Provider (usually a private sector company) allows them to on-sell a dataset. It is similar to the VAR agreement.
The end user (ie. the customer of the DSP) will sign a standard DALA with the licensor (the State of Victoria) or accept the terms and conditions by opening a shrink wrapped package or clicking a button online.
