Custodianship Data Distribution End User Agreements

End User Agreements

Overview
Distribution Access Licence Agreement (DALA)

This is a standard agreement between the licensor (DSE or Custodian in the case of a restricted dataset) and end user of a dataset. A DALA is signed for each dataset or its terms and conditions are accepted by opening a shrink wrapped package or clicking a button online. The DALA covers licence conditions (confidentiality, number of users, warranty and indemnity). It protects the interests of the custodian. Each DALA has a schedule which specifies fees, dataset name, duration of licence and update frequency.

End User Licence Agreement (EULA)

This is an agreement between a Value Added Reseller and end user. The VAR will decide on clauses such as the term of the agreement, fees or update frequency, but is required by their VAR agreement to incorporate the terms and conditions of the DALA to protect the interests of the State of Victoria and the Custodian.
